1. Scope
This Terms and Conditions Agreement ("Agreement") is made between the Client ("Client") and Glicia Carence ("Photographer"). The Client acknowledges that by making a deposit for the services, they are accepting all the terms and conditions outlined in this Agreement.
2. Pricing and Payment
2.1. Pricing
Prices may vary depending on the type of service selected by the Client. The applicable prices are those valid on the day the Photographer issues the quote to the Client (VAT included). The quote is valid for 15 days from its issue date. After this period, the Photographer reserves the right to modify the prices at her discretion.
2.2. Deposit
A non-refundable deposit is required for each order, as follows:
Photo session: €100
Wedding photography: 50% of the total amount
The Client acknowledges and agrees that the retainer is due upon the conclusion of the sale and is non-refundable, except in cases of force majeure (proof may be required), compensating the Photographer for time reserved and for declining other potential projects or clients. Both parties agree that the retainer will be credited towards the total fee payable by the Client.
2.3. Payment due date
The remaining balance must be paid by the Client on the day of the session for regular photoshoot services, or at least one month before the session in the case of weddings. Accepted payment methods include:

3. Delivery Commitments and Deadlines
3.1. Commitments
The Photographer commits to delivering the photography services as ordered, in accordance with the specifications agreed upon with the Client.
3.2. Confirmation and Delays
Each session must be confirmed no later than 1 week before the scheduled shoot. The session's start time is strict, and any delay by the Client will be deducted from the scheduled session time.
3.3. Delivery timeline
The estimated delivery time for digital images is 15 business days. For weddings, images are typically delivered within approximately 2 months.
3.4. Rush Fee
If the Client requires the final images to be delivered within 48 hours after the session, a rush service fee of €150 will apply (not applicable to weddings). This service is subject to the Photographer's availability.
3.5. Delivery format
Images will be delivered digitally, in high resolution, via a private online gallery. Only images selected and edited by the Photographer will be delivered. All photos are edited in the Photographer's signature grainy, film-like style and include both color and B&W images. B&W images are delivered only in black and white; no color versions are supplied. The Client will not have access to the original RAW files and the final images will not be re-edited under any circumstances beyond the initial editing process.
4. Cancellation
4.1. Session cancellation
In the event of a cancellation by the Client, the retainer remains non-refundable, except in cases of force majeure (proof may be required). No cancellation will be accepted for any session already done or in progress, and the full amount must be paid. The Photographer reserves the right to cancel the order in cases of force majeure, such as illness, accidents, death, fire, flood, etc. The Photographer will notify the clients as soon as possible in such cases.
4.2. Session changes
If the Client decides to shorten the session, a €70 change fee will apply, as this may impact the Photographer's schedule. If the Client wishes to extend the session, they must notify the Photographer at least one week in advance so the schedule can be adjusted. Extensions are subject to availability.
5. Liability and Force Majeure
5.1. Force Majeure
If the Photographer is unable to perform the session or deliver the images due to circumstances beyond her control (e.g., illness, fire, climate conditions, accidents, technical failures, transportation problems), and no suitable replacement can be provided, the Photographer will refund any fees received, minus expenses and the deposit. This will be the extent of the Photographer's liability.
5.2. Loss or Damage to Images
The Photographer will take every reasonable measure to ensure the safety and integrity of the images, but is not responsible for any loss or damage to the photographs or failure to deliver them due to circumstances beyond her control (e.g., illness, fire, climate conditions, accidents, technical failures, transportation problems).
6. Artistic Release
6.1. Consistency
The Photographer will make reasonable efforts to ensure the services provided are consistent with her current portfolio.
6.2. Style
The Client acknowledges and agrees that:
The Client has reviewed the Photographer's prior work and portfolio and understands that the service will be carried out in a similar style.
The Photographer will exercise her artistic judgment when providing the services and will have the final say regarding aesthetic decisions and the artistic quality of the delivered images.
Disagreement with the Photographer's aesthetic or artistic style is not a valid reason for canceling the order or requesting a refund.
7. Image Rights
The Photographer may freely use the photographs for promotional purposes, provided the rights of the photographed individuals and property are respected, unless a confidentiality agreement has been signed in advance with the clients. Clients agree that their image may be used on the Photographer's promotional materials, such as her website and social media. Under no circumstances will the Photographer use any photograph that could harm the clients' privacy, image, or reputation.
8. Intellectual Property
Photographs are considered works of art, as defined by intellectual property law, and the Photographer is their author (Art. L112-2 CPI). Photographs are reserved for personal use unless otherwise specified in a contract or quote for professional portraits. Any use of the photographs is subject to compliance with intellectual property law and copyright rules. No photograph may be altered in any way without prior written consent from the author. Clients agree to respect the integrity of the Photographer's works (Art. L121-1 CPI).
9. Applicable Law
All services provided by the Photographer are subject to French law.
